Terms of Service

Effective April 26, 2026

Welcome to htxmuslims. These Terms of Service (“Terms”) govern your access to and use of the website at htxmuslims.comand any related services, content, or features offered by us (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who We Are

“htxmuslims,” “we,” “us,” and “our” refer to the operators of htxmuslims.com, an online directory and editorial guide for Houston’s Muslim community. We publish neighborhood guides, listings of mosques, Islamic schools, halal food businesses, real estate agents, and other community resources, and we offer paid placements to qualifying real estate agents.

2. Eligibility

You must be at least 13 years old to browse the Service and at least 18 years old (or the age of majority in your jurisdiction) to submit content, create an account, or enter into any paid arrangement with us. By using the Service, you represent that you meet these requirements and that any information you provide is accurate.

3. Description of the Service

The Service includes, without limitation:

  • Editorial guides and articles about Muslim life, neighborhoods, and resources in the Houston metropolitan area;
  • A public directory of mosques, Islamic schools, halal restaurants and grocers, real estate agents, and other Muslim-owned or community-relevant businesses;
  • Forms for visitors to submit listings, contact us, or sign up to be listed as a real estate agent;
  • Real estate agent profiles and tiered placements, including paid Featured and Recommended placements (when offered);
  • Newsletter, events, and other features added from time to time.

We may modify, add, or remove features at our discretion without prior notice.

4. Accounts

Most of the Service is freely accessible without an account. Real estate agents may, in the future, create accounts to manage their directory listings. Account holders are responsible for:

  • Providing accurate, current, and complete information at signup and keeping it current;
  • Maintaining the confidentiality of any login credentials, magic-link emails, or session tokens;
  • All activity under their account, whether or not authorized;
  • Notifying us promptly of any unauthorized use or security breach.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.

5. License Verification & Real Estate Agent Listings

Real estate agents who request listings, whether free or paid, must hold an active license issued by the Texas Real Estate Commission (TREC). By submitting a listing request, you authorize us to verify your license status against TREC’s public records and to publicly display your license number on your profile and in directory views.

We perform license verification on a reasonable-efforts basis using publicly available data. We do not guarantee that any license information is current or accurate at any given moment, and we are not liable for losses caused by reliance on license information displayed on the Service. The phrase “Licensed since [year]” or any equivalent representation is derived from public TREC data and is provided for informational purposes only.

We reserve the right to refuse, suspend, or remove any agent listing for any reason, including but not limited to: invalid or expired license, complaints from consumers, conduct that violates these Terms, or our editorial discretion.

6. Tiered Placements & Paid Features

Real estate agent listings are offered in tiers. The free “Listed” tier includes a basic directory entry only. Paid tiers (“Claimed,” “Featured,” and “Recommended”) provide additional features such as a public profile page, expanded display, and exclusive placements. Pricing, scope of features, and availability of each tier are described on the Service and may change.

Recommended tier placements are exclusive within a given Houston-area neighborhood, billed monthly only, and subject to availability. We do not auction Recommended slots; we approve or decline applicants at our discretion based on credentials, fit, and review.

Paid placements (Featured, Recommended, and any future paid promotional features) are clearly identified as paid placements with appropriate visual treatment and disclosure language consistent with the Federal Trade Commission’s endorsement and advertising guidelines. Editorial content—including ranked lists, “best of” articles, and neighborhood guides—is not for sale and is created independently of any paid placement relationship.

By purchasing a paid placement, you agree:

  • Your placement is conditional on continued payment, ongoing license validity, and continued compliance with these Terms;
  • We may pause or remove your placement immediately for non-payment, license issues, fraud, harassment, complaints, or any other material concern, with or without notice;
  • You will not use your placement to advertise services unrelated to real estate, to make unverified claims, or to engage in conduct that misleads consumers.

7. Billing, Subscriptions & Refunds

Payments are processed by third-party payment processors (currently anticipated to be Stripe, Inc.). When you purchase a subscription, you authorize the processor to charge your payment method for the recurring fee disclosed at checkout until you cancel.

  • Cancellation: You may cancel any time via the Stripe Customer Portal or by contacting us. Cancellation takes effect at the end of the current billing period.
  • Refunds: Fees are non-refundable except where required by law or where we, in our sole discretion, choose to issue a refund.
  • Past-due payments: If a payment fails, we may suspend paid features. Recommended tier subscriptions enter a grace period as described on the Service before the slot is released.
  • Price changes: We may change subscription pricing on prospective billing cycles with reasonable notice via email.

All payment data is handled by the processor under its own terms and privacy policy. We do not store full credit card numbers on our servers.

8. User-Submitted Content

The Service allows you to submit content, including business listings, contact messages, agent listing requests, photos (such as headshots), event submissions, and any other materials we accept (collectively, “User Content”). When you submit User Content, you:

  • Represent and warrant that you own or have all rights, licenses, and consents necessary to submit it and to grant the license below;
  • Represent that the content is accurate, not misleading, and not unlawful, defamatory, infringing, harassing, or otherwise objectionable;
  • Grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (for technical formatting only), publish, publicly display, and distribute the User Content for the purposes of operating, promoting, and improving the Service;
  • Acknowledge that we may, but are not obligated to, review, edit, or remove User Content at our discretion.

You retain ownership of your User Content. The license you grant survives the termination of your account or removal of your content for as long as is reasonably necessary for our archival and legal compliance purposes.

9. Halal & Health-Related Disclaimers

Halal status:Halal claims on htxmuslims are based on each business’s own representation to the public or to us. We do not independently inspect, certify, or verify halal status, sourcing, slaughter methods, cross-contamination, or compliance with any particular madhab or scholarly opinion. Listings are not endorsements of halal authenticity. Consumers must conduct their own due diligence and rely on their own conscience and consultation with religious authorities.

Educational and editorial content on the Service, including guides on neighborhoods, mosques, schools, financing, and life decisions, is provided for general informational purposes only. It is not legal, financial, real estate, tax, religious, or medical advice. Always consult a qualified professional for advice specific to your situation.

10. Directory Listings & Third-Party Information

Many listings on the Service incorporate publicly available information from third-party sources, including the Google Places API, public registries, and information submitted by businesses themselves. We make a reasonable effort to keep listings accurate but make no warranty as to the completeness, accuracy, or currency of any listing or its underlying information (including hours, phone numbers, addresses, ratings, or operational status).

Inclusion of a business in our directory does not constitute an endorsement. Exclusion does not constitute disapproval. We reserve editorial discretion over what is listed.

11. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law;
  • Submit false, misleading, defamatory, harassing, or threatening content;
  • Impersonate any person or entity, or misrepresent your affiliation;
  • Submit content that infringes any intellectual property right of a third party;
  • Submit photos depicting persons without their consent;
  • Attempt to gain unauthorized access to the Service, its accounts, its admin areas, or its underlying infrastructure;
  • Interfere with or disrupt the Service, including by transmitting malware, performing automated scraping at scale, or circumventing rate limits or security measures;
  • Use the Service to send spam, unsolicited commercial messages, or to harvest contact information;
  • Use the Service to discriminate against any person on the basis of race, religion, national origin, sex, sexual orientation, disability, or any other protected characteristic.

12. Intellectual Property

All content published by us on the Service—including guides, articles, neighborhood overviews, photographs we own or license, the htxmuslims wordmark, the visual design and code of the Service, and any compilation of listings or directory data—is owned by us or our licensors and protected by intellectual property laws. You may view and share links to public content for personal, non-commercial purposes. You may not copy, scrape, republish, or redistribute substantial portions of our editorial or directory content without our prior written consent.

Trademarks.“htxmuslims” and our wordmark are our marks. All other names, logos, and marks referenced on the Service are the property of their respective owners.

13. Copyright & DMCA

We respect the intellectual property rights of others. If you believe content on the Service infringes your copyright, please send a notice to our contact form including: (i) a description of the copyrighted work, (ii) the location on the Service where the allegedly infringing material appears, (iii) your contact information, (iv) a statement that you have a good-faith belief the use is not authorized, (v) a statement under penalty of perjury that the information is accurate and that you are the owner or authorized to act on behalf of the owner, and (vi) your physical or electronic signature.

14. Third-Party Services & Links

The Service may link to or integrate with third-party services, including Google Places, Google Analytics, Vercel hosting, Supabase, Stripe (for payments), Resend (for email), and others. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party content, products, or services, and we do not endorse them.

15. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

We are not a party to any transaction between you and any business, real estate agent, or service provider listed on the Service. Any decisions you make in reliance on the Service—including hiring an agent, visiting a business, sending your child to a school, or making a financial commitment—are your responsibility alone.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, GOODWILL, OR DATA, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE TOTAL FEES YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (ii) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; if these laws apply, some of the above limitations may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless htxmuslims and its operators from and against any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising from: (i) your use or misuse of the Service; (ii) your User Content; (iii) your violation of these Terms; or (iv) your violation of any law or any right of a third party.

18. Termination

We may suspend or terminate your access to the Service or your account, in whole or in part, at any time and for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

19. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.

You should consult counsel about whether to add a binding arbitration clause and class-action waiver here. Many similar consumer-facing services include them; we have not included one in this draft so that you can make that decision deliberately.

20. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify users by email or by a prominent notice on the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

21. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
